Terms of Service
The agreement between you and Kasura for access to and use of the platform.
Service Scope
#Kasura provides rental management software, operational workflow tools, booking management systems, public booking website functionality, and related SaaS platform services.
Definitions
#For the purposes of these Terms:
"Kasura" means Kasura LLC and its affiliates where applicable.
"Operator" means the individual or business entity that registers for and uses Kasura to operate a rental business.
"User" means the Operator and any staff member, employee, contractor, or other person authorized to access the Operator's workspace.
"Workspace" means the Operator's organization, account, and all associated data, settings, staff members, assets, bookings, customers, documents, websites, and connected services managed through Kasura.
"End Customer" means any renter, guest, customer, passenger, or other person who interacts with an Operator through Kasura-powered booking websites, customer portals, booking requests, reservations, or rental transactions.
Role of Kasura
#Kasura is a software provider only. Kasura does not rent vehicles, does not provide accommodations, and does not own, operate, manage, sell, lease, or provide rental inventory.
The rental business operator is the contractual party with the end customer. Kasura is not a party to rental agreements, booking agreements, rental operations, or customer-facing operational transactions.
Kasura is also not a party to customer disputes, refunds, damage claims, insurance claims, or other claims arising between operators and their customers.
Public Booking Websites
#Public booking websites provided through Kasura are technical tools made available to rental operators for publishing and managing their own customer-facing booking presence.
Operators are responsible for all public site content and configuration, including listings, descriptions, photos, pricing, taxes, availability, rental rules, cancellation terms, customer communication, and reservation confirmations.
Kasura does not guarantee the accuracy, legality, availability, pricing correctness, or suitability of public site content published by operators.
Subscription Plans, Add-ons and Fair Use
#Kasura may offer different subscription plans, add-ons, usage limits, feature limits, promotional pricing, founder pricing, and billing intervals.
Plan limits may include, but are not limited to, the number of assets, staff accounts, booking websites, enabled features, communication usage, payment integrations, storage usage, or other operational limits.
Add-ons may be offered separately from subscription plans. Availability, pricing, included limits, and feature access may change over time.
Users are responsible for selecting a plan and add-ons suitable for their own business usage. If usage exceeds the limits of the active plan or add-ons, Kasura may restrict certain actions, require an upgrade, apply additional charges where applicable, or limit access to specific features.
Kasura may apply fair-use limitations to prevent excessive, abusive, fraudulent, infrastructure-heavy, or commercially unreasonable usage that materially exceeds the intended scope of a plan.
Founder / Early Access Plans
#Kasura may offer limited early access, founder, beta, tester, or promotional pricing plans to selected users.
Founder and early access plans may include access to features, functionality, or platform areas that are still under active development, testing, improvement, or modification.
Users acknowledge that early access services may contain bugs, interruptions, inaccuracies, incomplete functionality, temporary instability, or evolving platform behavior.
Kasura does not guarantee uninterrupted availability, feature permanence, or error-free operation for early access or founder plans.
Founder pricing may remain active only while:
- the account remains active,
- payments remain current,
- platform policies are respected,
- and fair-use limitations are not exceeded.
Kasura reserves the right to review excessive, abusive, fraudulent, infrastructure-heavy, or commercially unreasonable usage that materially exceeds the intended scope of a founder or promotional plan.
If a founder, legacy, promotional, or early access plan is cancelled, downgraded, paused, transferred, or materially modified, the same pricing or conditions may not be available again.
Account Responsibility
#Users are responsible for:
- Maintaining account security
- Protecting authentication credentials
- Providing accurate information
- Managing access within their workspace
- Activities performed through their account or organization
Users must be legally capable of entering binding agreements in their jurisdiction.
Workspace Ownership
#The Operator is responsible for the administration of their workspace and controls access granted to authorized Users.
The Operator is responsible for managing staff accounts, assigning permissions, removing access when appropriate, and ensuring that only authorized individuals have access to the workspace.
Unless otherwise agreed in writing, the Operator is considered the owner and administrator of the workspace and all associated subscription rights.
Kasura is not responsible for ownership disputes, internal business disputes, employment disputes, or access disputes between Users within the same workspace.
Operator Responsibilities
#Rental operators are solely responsible for operating their business in compliance with applicable laws and requirements in their jurisdiction.
This includes responsibility for:
- Local laws, rental laws, and tourism rules
- Licenses, permits, and required business authorizations
- Insurance coverage and safety requirements
- Tax obligations and consumer protection compliance
- Customer agreements, disclosures, and operational procedures
Contract Templates and Rental Documents
#Kasura may provide contract templates, rental agreement templates, pickup documents, return documents, booking summaries, signature flows, or related operational document features.
These documents are provided for convenience, operational organization, and workflow support only. They are not legal advice, do not replace advice from a qualified lawyer, attorney, notary, tax advisor, or other professional, and are not guaranteed to comply with the laws of any specific country, state, region, municipality, industry, or rental category.
Users are solely responsible for reviewing, editing, approving, and legally validating any contract, rental agreement, terms, waiver, policy, deposit clause, damage clause, insurance clause, cancellation clause, or customer-facing document before using it with their own customers.
Kasura does not guarantee that any template or generated document is legally valid, enforceable, complete, suitable for a specific business, suitable for a specific jurisdiction, or sufficient for any particular rental transaction.
Use of contract templates, generated documents, digital signatures, or related document features is at the user's own responsibility. Users remain responsible for their own legal compliance, customer disclosures, consumer protection obligations, insurance requirements, tax obligations, and rental business procedures.
To the maximum extent permitted by applicable law, Kasura shall not be liable for losses, disputes, claims, penalties, chargebacks, customer complaints, unenforceable agreements, missing clauses, incorrect clauses, translation issues, or business damages arising from the use, modification, non-use, or reliance on any contract template or generated rental document.
Compliance, Sanctions and Prohibited Use
#Detailed prohibited conduct is set out in our Acceptable Use Policy. The following is a non-exhaustive summary:
Users may not:
- Use the platform for illegal activity or fraud
- Use the platform in violation of sanctions, embargoes, or restricted-party rules
- Use the platform for restricted goods or restricted services
- Use the platform in violation of payment processor policies
- Attempt unauthorized access
- Upload malicious software or harmful content
- Interfere with platform stability or infrastructure
- Abuse, exploit, or reverse engineer services beyond permitted use
This includes compliance with rules and policies of Stripe when connected by the user.
Users are responsible for ensuring that their business activities are legally permitted in each jurisdiction where they operate, market, or serve customers.
Enforcement and Platform Protection
#Where reasonably necessary to protect users, the platform, payment ecosystems, or legal compliance obligations, Kasura may suspend accounts, restrict access, disable public booking websites, remove content, or terminate accounts.
Such actions may be taken for reasons including:
- Illegal activity, fraud, or abusive conduct
- Sanctions-related violations or restricted-party concerns
- Violations of Stripe requirements and related payment processor rules
- Security threats, malicious behavior, or platform integrity risks
- Violation of these Terms, published platform rules, or fair-use limits
Kasura may preserve relevant evidence and may cooperate, where legally appropriate, with payment providers, banks, competent authorities, or law enforcement.
Termination
#Users may terminate their Kasura subscription in accordance with the Cancellation Policy.
Kasura may terminate access to the platform where continued access would materially violate these Terms, applicable law, payment provider requirements, or the Acceptable Use Policy.
Termination does not affect obligations that are intended to survive termination, including payment obligations, intellectual property provisions, limitation of liability, and dispute resolution provisions.
Subscriptions and Billing
#Kasura may offer monthly subscription plans, yearly subscriptions, and free trial access. All prices exclude applicable taxes. Taxes are calculated securely by Stripe during checkout. Applicable VAT, GST or sales tax will be added where required by law. Billing details, payment methods, taxes, and chargebacks for your Kasura subscription are described in our Payment Terms.
Unless cancelled before the next billing cycle, subscriptions may renew automatically according to the active billing period and billing configuration. See our Cancellation Policy for cancellation timing and access after cancellation.
After cancellation, access may remain available until the end of the already paid subscription period.
Pricing structures, feature availability, and plan limitations may change over time.
Plan Changes, Upgrades and Downgrades
Subscription plans, feature access, limits, add-ons, and billing structures may evolve over time.
When upgrading between subscription plans, Kasura may apply prorated billing adjustments, credits, immediate charges, deferred charges, or updated billing cycles depending on the active billing configuration and payment provider behavior.
Downgrades, cancellations, or feature removals may result in reduced platform access, disabled features, or applicable usage limitations after the current billing period ends.
Some add-ons, promotional plans, founder plans, or legacy pricing structures may not be available again after cancellation, downgrade, or modification.
Data Export
#Operators remain responsible for maintaining copies of their business records where required by applicable law.
Where export functionality is available, Operators may export certain business data before their subscription ends.
Following account termination or deletion, Kasura may permanently delete platform data in accordance with the Privacy Policy, Data Processing Agreement, applicable legal obligations, and internal retention schedules.
Refund Policy
#Kasura generally does not provide automatic partial refunds for unused subscription periods unless required by applicable law. Taxes are calculated securely by Stripe during checkout. Refund treatment of tax follows Stripe and applicable law. See the Payment Terms and Cancellation Policy for refund and billing detail.
Refund decisions, where applicable, may depend on the specific situation, billing status, technical issues, legal obligations, or platform misuse considerations.
Intellectual Property
#Kasura and its licensors retain all rights, title, and interest in the Kasura platform, software, technology, branding, documentation, designs, user interface, and all related intellectual property.
Except for the limited right to use the platform under these Terms, no ownership rights are transferred to Users.
Operators retain ownership of their own business data, uploaded content, customer information, documents, branding, images, and other materials they provide through the platform.
Feedback
#Users may voluntarily provide suggestions, feature requests, comments, ideas, or other feedback regarding the platform.
Unless otherwise agreed in writing, Users grant Kasura a worldwide, non-exclusive, royalty-free right to use, modify, reproduce, and incorporate such feedback into the platform without compensation or attribution.
This section does not transfer ownership of the User's business data or other content uploaded to the platform.
Third-Party Integrations and Payment Providers
#Users may connect external services and providers, including payment systems, communication tools, hosting systems, analytics systems, email delivery systems, or other third-party platforms.
Kasura may provide technical integration features that allow rental businesses to connect their own Stripe account for end-customer payments.
Unless explicitly stated otherwise, Kasura does not act as the merchant of record for payments between rental businesses and their end customers. Rental businesses remain responsible for their own payment provider accounts, payouts, refunds, chargebacks, customer disputes, tax obligations, customer disclosures, and local payment compliance. Kasura is not responsible for outages, policy changes, pricing changes, account restrictions, payment holds, rejected payments, chargebacks, disputes, security incidents, compliance requirements, or operational behavior of third-party services connected by users.
Availability and Platform Changes
#Kasura aims to maintain stable and reliable platform access, but uninterrupted availability cannot be guaranteed.
Features, infrastructure, integrations, and platform behavior may change, evolve, or be discontinued over time.
Temporary downtime, maintenance periods, security actions, or infrastructure incidents may affect service availability.
Expanded Limitation of Liability
#To the maximum extent permitted by applicable law, Kasura is provided on an "as is" and "as available" basis without warranties of uninterrupted operation, guaranteed accuracy, guaranteed legal compliance, or guaranteed business outcomes.
Users remain responsible for independently verifying bookings, availability, pricing, customer information, operational decisions, contracts, payments, deposits, damage records, rental documents, and rental-related business activities.
Kasura shall not be responsible for losses resulting from user error, incorrect configuration, third-party failures, internet outages, communication failures, missed notifications, payment provider issues, double bookings, pricing inaccuracies, data entry mistakes, customer disputes, operational interruptions, or reliance on generated documents.
Kasura is not responsible for accidents, injuries, property damage, vehicle damage, accommodation damage, lost property, theft, insurance claims, or disputes arising from rental operations conducted by operators.
This limitation also applies to contract templates, rental documents, generated agreements, signature workflows, and any user-modified legal or operational documents created through the platform.
To the maximum extent permitted by applicable law, Kasura shall not be liable for indirect, incidental, special, consequential, punitive, business interruption, loss of profit, loss of revenue, loss of data, loss of goodwill, or similar damages resulting from platform usage, outages, data loss, third-party integrations, generated documents, payment provider issues, or operational disruptions.
Where legally permitted, Kasura's maximum aggregate liability shall not exceed the total subscription fees paid by the affected user during the twelve (12) months preceding the event giving rise to the claim.
Governing Law and Jurisdiction
#These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Kasura platform shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Wyoming, unless applicable law requires otherwise.
Nothing in these Terms limits any mandatory legal rights that cannot be waived under applicable law.

Survival
#Any provisions that by their nature should survive termination of these Terms shall remain in effect after termination, including but not limited to provisions relating to payment obligations, intellectual property, confidentiality, limitation of liability, governing law, dispute resolution, and data protection.
